Unlike domestic law, international law relies heavily on state cooperation and consent, making enforcement inconsistent.
- Limitations of the International Criminal Court (ICC): The ICC prosecutes individuals for crimes like genocide and war crimes, but its reach is limited to countries that have ratified the Rome Statute. Major powers, such as the United States, China, and Russia, have not ratified the Statute, limiting the court’s jurisdiction. Consequently, enforcement often depends on the political will of individual states.
- Selective Enforcement: Political considerations frequently influence enforcement. Powerful states may evade scrutiny, while weaker or less politically connected nations face harsher consequences. For instance, despite widespread documentation of abuses in Myanmar against the Rohingya people, international intervention has been limited, highlighting the inconsistency in enforcing human rights standards.
