A New Frontier of Rights
You wake up, check your phone, scroll through notifications, respond to messages, maybe post something, maybe delete something. Before you even leave your bed, you have already exercised freedom of expression, navigated privacy decisions, participated in a public sphere, and generated a trail of data that others can analyze, store, and monetize. This is what human rights look like in the digital age. They are no longer abstract principles written in documents. They are lived experiences embedded in everyday interactions with technology. When the Universal Declaration of Human Rights was adopted in 1948, rights were imagined within physical spaces. Freedom of assembly meant gathering in streets or meeting halls. Freedom of expression meant speaking, printing, or broadcasting. Privacy meant protection from physical intrusion or surveillance by the state. Today, these same rights operate within infrastructures that are invisible, algorithmic, and globally distributed. The “public square” is no longer a place you go. It is a platform you log into.
This shift fundamentally reshapes how power operates. Digital technologies have expanded human capabilities in extraordinary ways. A student in a rural village can access world-class education online. Activists can organize transnational movements within hours. Marginalized voices that were historically excluded from traditional media can now reach global audiences. At the same time, these same technologies introduce new forms of inequality and control. Data becomes a resource, and those who control it gain disproportionate power. Couldry and Mejias (2019) describe this transformation as data colonialism, a system in which human life itself becomes a site of extraction. Every click, every movement, every interaction becomes data that can be captured, analyzed, and sold. In this sense, the digital age is not just about communication. It is about the reorganization of economic and political power around information.
David Kaye (2019) reminds us that digital rights are not new rights. They are existing rights reinterpreted in a new context. But interpretation matters. The meaning of privacy, expression, and participation is shaped by the technologies through which they are exercised. And those technologies are designed, owned, and governed by a combination of corporations and states. The central question of this era is therefore not whether technology affects human rights. It is who controls the systems that define how those rights are experienced.
Internet Freedom and Global Governance

The Architecture of the Internet
The internet did not begin as a centralized system of control. It emerged through decentralized networks of collaboration among engineers, researchers, and early adopters who valued openness and innovation. Organizations such as ICANN, IETF, and W3C coordinate the technical standards that allow the internet to function, but they do not govern it in the traditional sense. There is no single authority that owns the internet. This decentralized structure initially fostered a sense of possibility. Early internet thinkers imagined cyberspace as a realm beyond the reach of traditional power structures. John Perry Barlow (1996) famously declared the independence of cyberspace, envisioning a digital world free from government interference. That vision did not last.
As the internet became central to economic systems, political communication, and national security, states recognized its strategic importance. Governments began to assert control, leading to competing models of internet governance. China developed a tightly controlled system of cyber-sovereignty, where the state regulates access, content, and data flows. The European Union pursued a rights-based model, emphasizing privacy and data protection through regulations such as GDPR. The United States historically favored a market-driven approach, allowing private companies to shape the digital landscape. These models reflect broader ideological differences about the relationship between the individual, the state, and the market. The result is a fragmented digital world where rights and freedoms vary depending on geography. The internet is no longer a single global space. It is a patchwork of regulatory regimes, often described as a “splinternet.”
Freedom Online Coalition and Digital Rights Norms
Efforts to preserve digital rights have emerged through both governmental and civil society initiatives. The Freedom Online Coalition, established in 2011, represents a group of governments committed to protecting human rights online. Its guiding principle is simple but powerful: rights that exist offline must also exist online. Civil society organizations play an equally important role. Groups such as Access Now, the Electronic Frontier Foundation, and Privacy International monitor government and corporate actions, advocate for stronger protections, and provide resources for individuals navigating digital risks. These organizations act as counterweights to concentrated power, ensuring that digital rights remain part of global conversations. Yet enforcement remains inconsistent. A right recognized in an international declaration can be undermined by national policies justified in the name of security, stability, or economic development. This tension between universal rights and national sovereignty defines the current landscape of digital governance.
Surveillance and the Security Dilemma
From Panopticon to Pan-Data
To understand surveillance in the digital age, it is useful to revisit Michel Foucault’s concept of the panopticon. In this model, individuals behave as if they are always being watched, even if they are not. Surveillance becomes internalized. Today, surveillance operates on a much larger scale. It is not confined to prisons or institutions. It is embedded in everyday life. Smartphones track location data. Cameras monitor public spaces. Online platforms record interactions. These systems generate vast amounts of data that can be used to predict behavior, influence decisions, and manage populations. The revelations by Edward Snowden in 2013 exposed the extent of state surveillance, showing how governments could access global communications through programs such as PRISM. But surveillance is not limited to governments. Corporations collect and analyze data at an unprecedented scale, creating detailed profiles of individuals. This shift from targeted surveillance to mass data collection represents a transformation in how power operates. It is no longer about watching specific individuals. It is about analyzing entire populations.
The Trade-Off Myth
One of the most persistent narratives in discussions of surveillance is the idea that privacy must be sacrificed for security. This framing suggests that increased surveillance is necessary to prevent threats such as terrorism or crime. However, evidence challenges this assumption. Mass surveillance programs have shown limited effectiveness in preventing attacks, while their impact on civil liberties is significant. When individuals know they are being monitored, they may self-censor, avoid certain activities, or withdraw from public discourse. Amnesty International describes this as a false choice. Security and human rights are not mutually exclusive. In fact, strong protections for rights can enhance security by fostering trust, participation, and accountability.
Surveillance Capitalism
Surveillance is not only a tool of the state. It is also a business model. Shoshana Zuboff (2019) describes surveillance capitalism as a system in which human experience is transformed into data that can be monetized. Every online interaction generates data that can be used to predict and influence behavior. Platforms design algorithms to maximize engagement, often prioritizing content that triggers emotional responses. This creates feedback loops that can amplify misinformation, polarization, and social division. The power imbalance is significant. Individuals generate data, but corporations control how it is used. Regulatory efforts such as GDPR and CCPA attempt to address this imbalance, but enforcement challenges remain.
The Right to Privacy in a Borderless World
Privacy is a foundational human right, yet it is increasingly difficult to protect in a digital environment. Data is stored across multiple jurisdictions, processed by complex systems, and shared among various actors. International frameworks attempt to address these challenges. The UN Human Rights Council has affirmed that privacy must be protected online. Treaties such as Convention 108+ establish standards for data protection. However, implementation varies widely, and many countries lack the capacity to enforce these standards.
The Right to Be Forgotten
The right to be forgotten reflects the tension between memory and privacy. In a digital world where information can persist indefinitely, individuals may seek to remove outdated or harmful content. This right raises important questions. Who decides what should be forgotten? How do we balance individual privacy with public interest? These debates highlight the complexity of regulating digital information.
Data Colonialism
At a global level, data flows often replicate existing inequalities. Countries in the Global South generate data that fuels AI systems, but the benefits are concentrated in wealthier regions. This dynamic mirrors historical patterns of resource extraction. Addressing data colonialism requires rethinking ownership, governance, and distribution of digital resources.
Big Tech and the New Power Geometry
Technology companies have become central actors in shaping the digital world. Their platforms influence how information is distributed, how communities interact, and how political debates unfold. This concentration of power raises questions about accountability. Unlike governments, corporations are not democratically elected. Yet their decisions have significant social and political consequences.
Algorithmic Power and Bias
Algorithms are often seen as objective, but they reflect the biases present in their data. Research has shown that systems can reproduce and amplify existing inequalities. Addressing algorithmic bias requires transparency, accountability, and inclusive design practices.
Global Digital Divides
Access to digital technologies remains uneven. While some regions benefit from advanced infrastructure, others face significant barriers.Bridging this divide requires not only technological solutions but also social and political efforts to ensure inclusive participation.
Cyber Rights Movements and Emerging Concepts
Digital rights movements advocate for greater control, transparency, and equity in the digital sphere. Concepts such as digital self-determination and data justice emphasize the need for collective governance of data.
